K 3 Spousal Visa
Requirements
The
K3 spousal visa requirement is that both parties are of legal
age to marry and free from any previous marriage. You must be a
U.S. citizen to obtain a K3 spousal visa for a husband or wife.
The K3 spousal visa cannot be obtained by a permanent resident.
If the marriage took place in the U.S. on another type of visa,
the spouse must leave the U.S. to be eligible to receive the K3
spousal visa.
You must be able to prove fully that
your marriage is legitimate the USCIS and the U.S. State
Department believe that a lot of the marriages are fraudulent
marriages. The government scrutinizes each international visa
application and will reject filings for any legitimate reason,
any minor error. If there are mistakes or omissions in your K3
marriage visa, it can and will delay the visa’s approval, which
is more time away from your spouse.
