K1 Fiancee Visa
There are generally two categories of
visas: immigration visas and non immigration visas. Visas are
coded by a system of letters from A-V. Some examples of non
immigration visa are tourist visa, student visa and K1 fiancee
visa.
The K1 fiancee visa is a non-immigrant visa
classification. The K1 fiancee visa allows foreigners to come to
the United States to marry U.S. citizens and live in the United
States.
Requirements for a K1 Fiancee Visa
You are a U.S. citizen and you have met
your fiancee (not on skype or web camera) in person with in two
years.
You and your fiancee both have a sincere intent
to marry each other with in 90 days of your fiancée's arrival in
the U.S.
You can meet the minimum income requirement for
the K1 Fiancée Visa.
Requirements for (K3)
(CR1) (IR1) Marriage visa
Presently Homeland Security is not processing K3 spousal or
marriage visa petitions. They are processing CR1, IR1 visa
petitions. CR1 visa will be issued by the consulate if at the
time of the interview the couple has been married less than two
years. The IR1 visa will be issued if at the time of the
interview the couple has been married longer than two years.
The CR1, IR1 visas include the issuance of the the Permanent
Green Card for your spouse soon after he/she arrives in the
United States. The Green Card actually costs less than they did
under the previous K3 spousal visa and less than the K1 fiancee
visa.
Requirements for the CR1, IR1 visas:
Petitioner must be a U.S. Citizen
Petitioner must be
legally married under the laws of the country where the marriage
took place
Petitioner must prove that the marriage
relationship is valid and sincere
U.S. Citizens must be
able to meet the financial requirements
If the marriage
was by proxy, it must have been consummated prior to the filing
of the marriage visa.
